Section 104(b) of the LLEBG Program's legislative framework addresses funding disparities among jurisdictions. By statute, a potential disparate situation exists when within a County, one or multiple municipalities' funding amounts are greater than the county's funding amount by 200% (single municipality) and 400% (multiple municipalities). At the same time, the county must bear more than 50 percent of prosecution and/or incarceration costs arising from Uniform Crime Report (UCR) Part 1 violent crimes reported by the corresponding municipality. In disparate situations, where a county is disparate with multiple municipalities (400%), the county must be able to show that said disparate allocations is likely to threaten the efficient administration of justice at the county level.

The LLEBG Program has a process to address these potential disparate situations. Potential disparate municipalities are identified during the allocation formula process. The statute requires the State Attorney General (SAG) to certify that a disparity either does or does not exist among the jurisdictions identified by BJA. The FY 2004 SAG certification process opened on May 17, 2004 and closed on May 28, 2004.

Jurisdictions certified as disparate by the SAG must agree on whether they will share funds and in what proportion. Neither BJA nor SAGs are required to have a role in this process. If an agreement cannot be reached, none of the jurisdictions involved in that particular disparate situation may apply for funding.
