Using a simple format, this book provides edited texts of leading U.S. Supreme Court constitutional cases on the investigation and prosecution of crime heard during the current Court term.
Abstract
Selected provisions of the U.S. Constitution are presented as background for the cases to follow. Five of the cases presented focus on due process of law, and 46 cases pertain to arrest and search and seizure under the fourth amendment. Electronic surveillance, agents and informers, and entrapment were addressed in six cases; the right to counsel was considered in nine cases. Twenty-one cases featured the privilege against self-incrimination, and lineups were examined in four cases. Likewise, four cases focused on preliminary examination, two cases on bail, one on indictment, two on the right to a speedy trial, two on plea bargaining, two on trial by jury, and nine on trial procedures. Other constitutional topics on which cases were heard were double jeopardy (three cases), sentencing (three cases), and collateral attack (two cases). Dissents are included.
