This report analyzes a number of policy options for complying with the West Virginia Supreme Court of Appeals' order (Crain v. Bordenkircher, 1986) that the penitentiary at Moundsville be closed by July 1, 1992, because of irremediable, constitutionally inadequate conditions.
Abstract
Following a review of the correctional crisis in inmates' rights throughout the Nation and in West Virginia, the report details the history and content of the court's ruling in Crain v. Bordenkircher. A chapter then analyzes the penitentiary replacement options beginning with brief discussions of contemporary prison housing and construction concepts. An analysis of renovation/construction options under the assumption of one penitentiary located at Moundsville considers the following options: new housing/renovation of existing housing, partial new housing, and construction of a totally new facility. Options under other assumptions are also reviewed. Financing options and the National Construction Information Exchange Program are discussed. A chapter on the privatization option identifies forms of privatization followed by a review of the possible advantages and problems with privatization. The report does not recommend a particular strategy for addressing the Moundsville situation, but analyzes options for consideration by policymakers. 95 references
