THIS STUDY INVOLVED A STATISTICAL ANALYSIS OF THE CASELOADS OF THE STATE SUPREME COURT, COURT OF CRIMINAL APPEALS, AND COURT OF CIVIL APPEALS, PLUS A DESCRIPTION OF INDIVIDUAL COURT OPERATIONS.
Abstract
THIS REPORT PRESENTS THE PRINCIPAL FINDINGS DERIVED FROM THIS STUDY, THE CONCLUSIONS OF THE NATIONAL CENTER FOR STATE COURTS (THE ORIGINATOR OF THE STUDY), AND THE CENTER'S RECOMMENDATIONS FOR IMPROVEMENT, WHERE APPROPRIATE. INDIVIDUAL CHAPTERS INCLUDE THE FOLLOWING AREAS: AN OVERVIEW OF THE APPELLATE PROCESS: EXPEDITING SUBMISSION OF APPEALS; JURISDICTION AND COMPOSITION OF COURTS OF APPEAL (INCLUDING COMPENSATION), SELECTION AND TENURE); THE RECORD, BRIEFS, AND ORAL ARGUMENT; MOTION PRACTICE AND EXTRAORDINARY WRITS; COURT COSTS AND FILING FEES; INTERNAL PROCEDURES; CLERK'S OFFICE PROCEDURES; AND THE LIBRARY, JUDICIAL BUILDING, AND THE COURTS' FISCAL AFFAIRS. THE APPENDIX CONTAINS A COMPARISON ALABAMA APPELLATE COURT JUDICIAL PRODUCTIVITY AND TIME UNDER ADVISEMENT TO THAT OF OTHER APPELLATE COURTS, COPIES OF ALL THE DATA COLLECTION FORMS AND INSTRUCTIONS USED IN THE STUDY, AND A DISCUSSION OF STATISTICAL METHODS.
