This report presents the numbers, provisions, status, and date of last action for Federal and each State's legislation as of 2016 that pertains to the establishment, responsibilities, and operations of State Prescription Drug Monitoring Programs (PDMPs).
Abstract
At the Federal level, two laws pertinent to PDMPs were enacted in 2016. Senate Bill 483 created the "Ensuring Patient Access and Effective Drug Enhancement Act. " This law provides that not later than 1 year after this law's enactment, the Secretary of Health and Human Services, in coordination with the Administrator of the Drug Enforcement Administration and in consultation with the Secretary of Defense and Secretary of Veterans Affairs, shall submit a report to various House and Senate committees that identifies beneficial improvements to State PDMPs. The second piece of Federal legislation pertaining to PDMPs is Senate Bill 524. This legislation created the "Comprehensive Addiction and Recovery Act of 2016." This legislation includes the requirement that States have a plan to apply the latest advances in technology in order to incorporate PDMP data into the work flow of drug prescribers and dispensers. Information on this Federal legislation is followed by a review of each State's legislation pertinent to the establishment, responsibilities, and operations of the State's PDMP.
