This manual sets forth Federal policies on asset forfeiture published by the Asset Forfeiture and Money Laundering Section of the U.S. Department of Justice.
Abstract
This edition of the Asset Forfeiture Policy Manual is divided into 12 sections: Seizure/Restraint; Administrative and Judicial Forfeiture; Settlements; Third Party Interests; Use and Disposition of Seized and Forfeited Property; Equitable Sharing; Assets Forfeiture Fund; Attorney's Fees; Grand Jury; International Forfeiture; Appointment of Trustees; and Litigation Issues. The edition contains new policies which include: (1) new material on equitable sharing; (2) new material on the deadline for filing a civil forfeiture action in cases that do not begin as administrative proceedings; (3) new policy on Internet publication of notice of the order of forfeiture in criminal cases; and (4) ethical issues arising in connection with parallel civil and criminal forfeiture proceedings. The manual published by the Asset Forfeiture and Money Laundering Section of the U.S. Department of Justice sets forth the policies of the U.S. Department of Justice and replaces and supersedes all previous editions of the manual, as well as policy directives and Interim Legal Advice Memoranda issued prior to October 2007.
