Abstract
LEGISLATIVE STATUTES, AND FEDERAL AND STATE COURT CASES ALLOWING DIRECT COMMITMENT AND TRANSFER OF YOUTH TO PENAL INSTITUTIONS ARE ANALYZED. LEGAL AND SOCIAL PROBLEMS IN TREATING OLDER AGGRESSIVE DELINQUENTS ARE DISCUSSED, AS ARE RECOMMENDED CORRECTIVE ACTIONS FOR PROVIDING PROCEDURAL SAFEGUARDS TO THE CRIMINAL LAW FOR YOUTH BEFORE INCARCERATION.
