This report represents the first formal attempt to depict the status of environmental crime prosecution in the U.S.
Abstract
Quantitative data were collected through surveys of environmental crime prosecutors. The data showed that local prosecutors are performing the bulk of environmental prosecutions in this country. The data also indicated which jurisdictions are responsible for environmental crime prosecutions. In addition, this report describes qualitative data gathered through interviews with prosecution, law enforcement, and regulatory personnel visited in seven local jurisdictions. The information presented here reveals the decision making processes of these personnel as well as the manner in which district attorneys must coordinate multi- agency efforts in innovative ways. The report includes a literature review, a State-by-State matrix and compilation of frequently used environmental statutes, and a list of environmental crime prosecution and investigation personnel who participated in the preparation of this report.
