This report reviews the compliance of the Presidential commission on the Human Immunodeficiency Virus Epidemic with selected provisions of the Federal Advisory Committee Act (FACA), as well as the White House process used to identify potential or actual conflicts of interest of the Commissioners.
Abstract
A review of conflict of interest laws, executive orders, and regulations, interviews with White House officials and four Commissioners, and an analysis of other information indicates that the Commission complied with the principal requirements of FACA. The Commission was properly established and chartered, provided advance notice of its meetings, prepared minutes of its meetings, and made records available to the public. It also provided the public with the opportunity to participate in and comment on matters discussed in its meetings prior to the issuance of reports. Some instances of noncompliance were found in the notification and reporting procedures used. Further, some irregularities in the conflict of interest waiver provisions also were found. These irregularities exposed Commission members to risk of possible criminal violations. Supplemental information is appended.
