This document from the Kansas Sentencing Commission contains the 2011 desk reference manual for the State's sentencing guidelines.
Abstract
This desk reference manual contains general instructions for application of the provisions enacted under the Kansas Sentencing Guidelines Act (KSGA) of 2011. The manual also discusses changes to the State's criminal code that were enacted by the State legislature in 2011: the Kansas Criminal Code was recodified, the new DUI bill was enacted, the Kansas Offender Registration Act (KORA) was substantially amended, the PSI and Journal Entry forms now include the "DV Case" designation, and the Kansas Prisoner Review Board has replaced the Kansas Parole Board. The instructions in this manual are presented in 10 chapters: Chapter 1 - The Basics of Sentencing Guidelines; Chapter 2 - Procedures Prior to Sentencing; Chapter 3 - Crime Severity Levels; Chapter 4 - Criminal History; Chapter 5 - Presentence Investigation Reports; Chapter 6 - Sentencing; Chapter 7 - Appeals; Chapter 8 - Community Sanctions and Postrelease Supervision; Chapter 9 - Retroactivity; and Chapter 10 - Points of Interest About the Guidelines. Additional sections of the manual include 2011 legislative changes to the KSGA and related criminal law, a time line of selected events related to the KSGA, and selected case law decisions and attorney general decisions on topics related to the KSGA. Appendixes
