This report provides general instructions on the use of the Maryland sentencing guidelines system and on the determination of a sentence under the guidelines provided.
Abstract
The types of offenses covered by the guidelines are offenses against persons, drug offenses, and property offenses tried in circuit court. Prior to the sentencing decision, the appropriate worksheet should be completed on each convicted count for which the offender is to be sentenced. A copy of each completed worksheet should be forwarded to both the defense attorney and the prosecutor. The guideline sentence range must be adhered to unless the judge states in writing reasons for a decision that is outside the range. Computing the scores for offenses covered by the guidelines is described, and sample computations and sentencing worksheets are supplied.
