Rescinding and replacing a prior version released in 2010, this guide assists states in monitoring and achieving compliance with the core requirements of the Formula Grants Program authorized under the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for awards made for fiscal year (FY) 2019 and previous years.
Abstract
The introductory chapter contains an overview of the provisions of the JJDPA. This is followed by a chapter on standards for adequate compliance monitoring systems. This chapter provides guidance on written compliance monitoring policies and procedures, monitoring authority, monitoring timetable, addressing complaints of noncompliance with the core JJDPA requirements, compliance monitoring system barriers, adherence to federal definitions, identification of the monitoring universe, classification of facilities within the monitoring universe, state inspection of facilities, compliance data collection and verification, and compliance data analysis and reporting. The guide's third chapter focuses on compliance with core JJDPA requirements. These requirements address the deinstitutionalization of status offenders (DSO), the separation of juveniles from adult inmates, and the removal of juveniles from jails and lockups for adults. The fourth chapter discusses the establishment of compliance standards by the U.S. Justice Department's Office of Juvenile Justice and Delinquency Prevention (OJJDP). The fifth chapter presents guidelines for the monitoring of facilities for their compliance with DSO, separation of juveniles from adult inmates, and the removal of juveniles from jails for adults. The remaining two chapters address compliance-monitoring report requirements and the OJJDP annual compliance determination assessment.
