THE COMMISSION SUGGESTS CHANGES TO VARIOUS PRETRIAL, TRIAL AND SENTENCING PROCEDURES IN ORDER TO COPE WITH PROBLEMS OF TERRORIST ADJUDICATION, ESPECIALLY WITNESS, AND JUROR INTIMIDATION, DURING THE PRESENT 'EMERGENCY.'
Abstract
EMERGENCY MODIFICATIONS ARE RECOMMENDED FOR THE RULES AND PROCEDURES IN THE FOLLOWING AREAS: RULES OF EVIDENCE, THE ARMY'S POWERS OF ARREST AND DETENTION, DETENTION BY EXTRA-JUDICIAL ORDER, TRIAL BY JURY, BAIL, ONUS OF PROOF OF FIREARMS/EXPLOSIVES POSSESSION, ADMISSIBILITY OF CONFESSIONS AND SIGNED STATEMENTS, AND THE DETENTION AND SENTENCING OF YOUTHFUL OFFENDER AND JUVENILE TERRORISTS. THE SCHEDULED OFFENCES PERTAINING TO TERRORIST ACTIVITY ARE APPENDED.
