This is a report on the design of a comprehensive study of cybercrime presented as part of item 6 of the provisional agenda of the 20th session of the Commission on Crime Prevention and Criminal Justice of the United Nations (U.N.) Economic and Social Council.
Abstract
The design of the comprehensive study of cybercrime was developed by the open-ended intergovernmental expert group on the comprehensive study of the problem of cybercrime. This expert group was established by the Commission in implementing paragraph 42 of the Salvador Declaration on Comprehensive Strategies for Global Challenges: Crime Prevention and Criminal Justice Systems and Their Development in a Changing World. In accordance with the mandate, the expert group focused on the design of a comprehensive study of cybercrime and responses to it by U.N. member states, the international community, and the private sector. The aim of the study is to examine options to strengthen existing and to propose new national and international legal or other responses to cybercrime. The expert group reviewed and adopted the annexed outcome documents, entitled "Collection of Topics for Consideration in a Comprehensive Study on the Impact of and Response to Cybercrime" (annex I), as well as a "Methodology for the Study" (annex II). These documents were transmitted to the Commission for consideration at its 20th session. Annex I outline and briefly discuss 12 topics to be addressed in the comprehensive study of cybercrime. The topics encompass an analysis of the problem of cybercrime, legal responses to cybercrime, prevention and criminal justice capabilities in responding to cybercrime, international efforts, and technical assistance. Annex II, "Methodology for the Study," notes that the U.N. Office on Drugs and Crime will develop the study, including the creation of a questionnaire, collecting and analyzing data, and the developing a draft test of the study.
