The United Nations General Assembly adopted, in 1991, a model treaty on the transfer of supervision of conditionally sentenced and conditionally released offenders.
Abstract
This treaty is applicable in cases where a final court decision has found a person guilty of an offense and has placed the offender on probation without sentence having been pronounced, given a suspended sentence involving deprivation of liberty, or given a sentence the enforcement of which has been modified or conditionally suspended. The articles of this treaty cover channels of communication, required documents, decision on the request, ground for refusal, dual criminality, the position of the sentenced offender, the rights of the victim, the effects of the transfer of supervision on both the sentencing and the administering states, pardon and amnesty, information, and costs.
