Abstract
Senate Bill 318 defines a "sexually violent person" (SVP) and specifies commitment proceedings for a SVP. Other provisions related to SVPs address criteria for supervised release, battery by certain committed persons, escape from custody, and penalties. The bill revises the definition of a SVP. A SVP is defined in terms of an "act of sexual violence." Acts of sexual violence are defined to include the addition of third-degree sexual assault and the following offenses if they are determined to be sexually motivated: felony murder, administering a dangerous or stupefying drug, robbery, and physical abuse of a child. Being "sexually motivated" means that the purpose for an act is the actor's sexual arousal or gratification or for the sexual humiliation or degradation of the victim. This bill stemmed from the work of the Special Committee on Sexually Violent Person Commitments, which was established by the Joint Legislative Council for the purpose of reviewing current law on the commitment, periodic re-examination, supervised release, and discharge of sexually violent persons. One section of this report summarizes the meetings of the committee.
