A COMPREHENSIVE PLAN FOR UNIFYING MAINE'S TRIAL COURTS UNDER STATE AUSPICES.
Abstract
THIS STUDY REAFFIRMS THE ROLE OF THE MAINE SUPREME COURT'S CHIEF JUSTICE AS THE CHIEF ADMINISTRATOR OF THE COURTS AND EMPHASIZES THE NEED FOR ADMINISTRATIVE ASSISTANCE. THE CREATION OF JUDICIAL, ADMINISTRATIVE REGIONS IS RECOMMENDED, WITH CONSIDERATION GIVEN TO REGIONAL VENUES, A PRESIDING JUSTICE FOR EACH REGION ADMINISTRATIVE COORDINATION, AND A TERM SYSTEM FOR THE JUDICIARY OTHER ISSUES ADDRESSED ENCOMPASS APPOINTED CLERKS OF COURT, CHANGES OF VENUE, STATE FINANCING OF THE COURTS (A NECESSITY TO INSURE EQUAL PROVISION OF JUSTICE), CENTRAL ADMINISTRATIVE MATTERS, A JUDICIAL CENTER, FACILITIES, AND SOUND RECORDING METHODS FOR TRIAL TRANSCRIPTS. SIXTEEN PROPOSED CONSTITUTIONAL AMENDMENTS AND STATUTES TO FACILITATE IMPLEMENTATION OF THE PLAN ARE INCLUDED.
