Recommendations are presented for reducing case processing delays within Michigan's trial court system.
Abstract
Time guidelines are provided that define delay, reaffirm the courts' responsibility for controlling caseflow through modern management techniques, require each court to have an individually tailored delay-reduction program, and provide for a transitional program to allow courts to reduce existing backlogs. Amendments are proposed to court rules covering summary disposition, motions, discovery, pretrial conferences, mediation, dismissals, conduct of trials, general procedures, and appeals. Additional proposals cover attorney schedule conflicts and alternative dispute resolution. Proposed statutory amendments deal with examination of defendants, testimony, and the insanity defense. Specific recommendations for the supreme court, the court administrative office, and the trial courts are provided. Appendixes provide additional commentary on case processing guidelines and proposed forms. 12 footnotes.
