This CD-ROM presents national, State, and local standards relating to five major aspects of indigent defense.
Abstract
The first standard is the administration of defense systems. This volume includes the scope of representation, financial eligibility, right to counsel, plan for defense services, assigned counsel systems, and contract defense. The second standard is attorney performance. This volume includes the function of standards, attorney qualifications and responsibilities, lawyer-client relationship, investigation and preparation, trial, and after conviction. The third standard is capital case representation. This volume includes counsel appointment, plan elements, workload, and attorney pretrial, trial, sentencing, and post-judgment performances. The fourth standard is appellate representation. This volume includes appellate offices, defender administrative process, caseload, attorney qualification, and training and performance. The fifth standard is juvenile justice defense. This volume includes attorney role, juvenile defense administration, counsel appointment, attorney initial duties, transfer hearing, plea negotiations, trial, and post-dispositional hearing duties. The standards are non-case specific statements that help policymakers assess the adequacy or appropriateness of the provision of defense services to indigent defendants. These standards and rules were issued by national organizations; State agencies and organizations, including bar associations, public defender agencies, and State high courts; and local court or bar associations.
