This protocol provides guidelines for the prosecution of misdemeanor domestic violence cases by the San Francisco District Attorney's Office.
Abstract
Following a definition of domestic violence, criteria for charging are presented; and evidence collection (written statements, drop statements, photographs) is discussed. Disposition recommendations cover incarceration, counseling and other treatments, and pretrial diversion, including assessment of case suitability for diversion. Cases appropriate for dismissal are characterized. Services offered by the Domestic Violence Project are described, including evidence collection, victim/witness court preparation, investigative workups, victim options counseling, and preparation of stay-away orders. An information sheet for domestic violence victims describes information required by the District Attorney, possible options and outcomes, and application procedures for stay-away and restraining orders. Forms for use with the protocol are provided.
