This statement of policy and guidelines from the Federal Bureau of Prisons implements zero tolerance toward all forms of sexual activity by prison inmates and staff, including sexual abuse and sexual harassment.
Abstract
In compliance with the Federal Prison Rape Elimination Act (PREA) of 2003, this policy issuance clarifies the interaction between the Bureau of Prisons policies and the PREA regulations that became effective August 20, 2012. Under this policy, each Federal correctional institution is required to have a current "Institution Supplement," which reflects that institution's unique characteristics and specifies how each institution will comply with this Program Statement. The Institution Supplement must specify staff members responsible for staff training activities that ensure a coordinated response to a report of sexually abusive behavior, as well as inmate education on issues that pertain to sexually abusive behavior. Other issues required to be addressed in the Institution Supplement are notification procedures followed when sexually abusive behavior occurs, procedures for responding to an inmate victim, and the monitoring of the inmate perpetrator. References include a listing of relevant program statements by the Bureau of Prisons from 2003 through 2012, as well as relevant Bureau of Prison forms and records retention requirements.
