This Bulletin from the Assistant Attorney General of the Environment and Natural Resources examines environmental crimes.
The Division's mission is to vigorously defend environmental, wildlife and natural resources laws and agency actions; ensure the effective stewardship of public lands and natural resources; and maintain the careful and respectful management of the United States' trust obligations to Native Americans. This Bulletin shares insights and experiences on the enforcement of civil and criminal environmental laws that protect the Nation's air, land, water, and natural resources. These articles focus on law and policy relating to the criminal prosecution of environmental, wildlife and natural resource cases, and related offenses. Emerging issues in practice are included, such as the propriety of applying environmental justice principles to criminal enforcement, the use of the environmental laws to help protect the Nation's workers, and the recent amendments to the Lacey Act to combat illegal logging. Other articles discuss when a prosecution for strict liability or negligence is appropriate. The remainder of the articles survey selected environmental crimes statutes and highlight general criminal law issues that environmental crimes prosecutors are likely to encounter.
