Based on the experience of pilot programs tested in California, Michigan, and Connecticut, this manual is designed to guide judicial educators in developing and conducting a comprehensive judicial education program on criminal court cases involving domestic assault.
Abstract
The program focuses on judicial practices and decisionmaking at each of the three main stages of a criminal case: pretrial proceedings and release decisions, the evidentiary hearing or trial, and case disposition. The program has two related parts: a bench guide on domestic violence criminal court cases and an 8-hour judicial education seminar. The bench guide presents criminal court cases specific to individual State laws and case law. It serves as preparatory reading for participants prior to the seminar, as a reference for faculty and participants during the seminar, and as a reference for judges upon returning to the courtroom. The manual includes the content for the bench guide, citations to leading statutory authority and case law, WESTLAW keynotes for topic areas to assist in identifying relevant State statutes and case law, an 8-step guide to developing the program, teaching outlines for program faculty, and appended handouts designed for distribution at different points in the program.
