UNIFORM GUIDELINES ON EMPLOYEE SELECTION PROCEDURES ADOPTED BY THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION, CIVIL SERVICE COMMISSION, DEPARTMENT OF LABOR, AND DEPARTMENT OF JUSTICE ARE SET FORTH.
Abstract
PRIOR TO ADOPTION OF THE UNIFORM GUIDELINES ON SEPTEMBER 25, 1978, TWO DIFFERENT SETS OF GUIDELINES GOVERNED THE EQUAL EMPLOYMENT OPPORTUNITY REGULATORY ACTIVITIES OF FEDERAL AGENCIES. THE UNIFORM GUIDELINES ARE INTENDED TO ESTABLISH A SINGLE FEDERAL POSITION WITH REGARD TO PROHIBITING DISCRIMINATION IN EMPLOYMENT PRACTICES ON GROUNDS OF RACE, COLOR, RELIGION, SEX, OR NATIONAL ORIGIN. THE BACKGROUND OF THE UNIFORM GUIDELINES IS TRACED, AND THE BASIC PRINCIPLES THEY EMBODY ARE EXPLAINED. PARTICULAR ATTENTION IS DIRECTED TO THE CONCEPT OF ADVERSE IMPACT--HOW EMPLOYERS ARE TO DETERMINE WHETHER THEIR POLICIES OR PRACTICES ARE HAVING AN ADVERSE IMPACT ON EMPLOYMENT OPPORTUNITIES OF MINORITIES AND FEMALES, HOW ADVERSE IMPACT CAN BE MODIFIED OR ELIMINATED, HOW THE JOB-RELATEDNESS OF PERSONNEL SELECTION AND PROMOTION TESTS CAN BE VALIDATED, WHAT REPORTING AND RECORDKEEPING PROCEDURES ARE REQUIRED OF EMPLOYERS, AND HOW AFFIRMATIVE ACTION RELATES TO VALIDATION AND TO ELIMINATION OF ADVERSE IMPACT. COMMENTS RECEIVED FROM PSYCHOLOGISTS, EMPLOYERS, CIVIL RIGHTS GROUPS, AND OTHERS IN THE COURSE OF DEVELOPING THE UNIFORM GUIDELINES ARE SUMMARIZED, AND CHANGES THAT WERE INTRODUCED IN RESPONSE TO SOME OF THE COMMENTS ARE NOTED THE FULL TEXT OF THE GUIDELINES--GENERAL PRINCIPLES, TECHNICAL STANDARDS, DOCUMENTATION OF IMPACT AND VALIDITY EVIDENCE, AND DEFINITIONS--IS SET OUT. OFFICIAL CITATIONS FOR THE GUIDELINES THEMSELVES AND FOR EACH AGENCY'S INCLUSION OF THE GUIDELINES IN ITS OWN RULES AND REGULATIONS ARE PROVIDED. (LKM)
