Abstract
IN VIEW OF THE 1972 SUPREME COURT DECISION IN FURMAN V GEORGIA, THIS STUDY WAS ORDERED. THE PURPOSE WAS TO DETERMINE WHETHER THE DEATH PENALTY SHOULD BE RETAINED IN SOME FORM IN FLORIDA, AND TO RECOMMEND ALTERNATIVES OR TO DEFINE CAPITAL CRIMES, DEPENDING ON THE DETERMINATION. FOUR PUBLIC HEARINGS WERE CONDUCTED, AND THE MINUTES AND RELATED MATERIALS SUCH AS TABLES OF DATA, CASE RESUMES, POSITION PAPERS, AND REMARKS OF PARTICIPANTS ARE GIVEN. A LEGAL ADVISORY STAFF REPORT, INDICATING CONSTITUTIONAL EFFECTS OF THE FURMAN DECISION IS ALSO INCLUDED. VARIOUS POSITION STATEMENTS BY MEMBERS OF THE COMMITTEE ARE PRESENTED AS WELL. THE COMMITTEE REACHED A PRELIMINARY DECISION TO SEEK REINSTATEMENT OF CAPITAL PUNISHMENT AND APPOINTED A SUBCOMMITTEE TO PREPARE SPECIFIC RECOMMENDATIONS. PROPOSED LEGISLATIVE REVISIONS OF CAPITAL PUNISHMENT STATUTES ARE ALSO GIVEN.
