DETAILED RECOMMENDATIONS AND SUPPORTING DATA BASED ON A SURVEY OF EXISTING PRACTICES WHICH RECOMMENDS CONSOLIDATION OF THE VARIOUS COURTS INTO THE EXPANDED JURISDICTION OF THE STATE DISTRICT COURTS.
Abstract
LOUISIANA NOW HAS CITY, MAYOR'S, JUSTICE OF THE PEACE, JUVENILE AND FAMILY COURTS. IT IS URGED THAT ALL OF THESE COURTS OF LIMITED AND SPECIAL JURISDICTION BE ABOLISHED AND THE DISTRICT COURT SHOULD BE REORGANIZED IN ACCORDANCE WITH THE MANAGEMENT FRAMEWORK RECOMMENDED IN A 1972 REPORT ON THE LOUISIANA COURT SYSTEM. SPECIAL AND LIMITED JURISDICTION MATTERS COULD BE HANDLED BY CREATING SPECIAL DIVISIONS OF THE DISTRICT COURT. DIVISIONS OR CALENDARS COULD BE ORGANIZED BY CASE TYPE OR SPECIAL CHARACTERISTICS. THE ENTIRE REORGANIZED COURT SYSTEM WOULD BE THE FINANCIAL RESPONSIBILITY OF THE STATE. IN THIS WAY, TRAFFIC AND JUVENILE CASES WOULD BE HANDLED IN A UNIFORM MANNER THROUGHTOUT THE STATE. ADDITIONALLY, PROSECUTION, DEFENSE, AND COURT SOCIAL SERVICES COULD BE CONSOLIDATE AND IMPROVED IF THERE WERE ONLY ONE COURT SYSTEM INVOLVED. A DETAILED APPENDIX CONTAINS THE SURVEY INSTRUMENTS AND TABULATED RESULTS. (AUTHOR ABSTRACT MODIFIED)
