This 2010 Annual Report of California's Commission on Judicial Performance (CJP) reviews its complaint process, legal authority, and procedures; and it presents 2010 data on the CJP's work, along with case summaries, budget, and personnel.
Abstract
The CJP's legal mandate is to protect the public, enforce rigorous standards of judicial conduct, and maintain public confidence in the integrity and independence of the judicial system. Following an overview of the CJP's complaint process, its legal authority and procedures are reviewed. CJP statistics for 2010 encompass cases that involve both active and former judges. The statistics address complaints received and investigated, deferral of investigations, complaint dispositions, and a 10-year summary of CJP activity. Case summaries pertain to public discipline (public censure and public admonishment by the CJP) and private discipline (private admonishments and advisory letters). Statistics are also provided on CJP's actions that involved subordinate judicial officers. In addition, data are reported on voluntary and involuntary disability retirement as well as restoration to capacity for service. The concluding section presents information and data on CJP's organization, staff, and budgets for 2010-2011 and 2009-2010. Appendixes contain governing provisions, the California Code of Judicial Ethics, the complaint form, and a CJP proceedings chart.
