THE COSTS AND BENEFITS LIKELY TO BE ASSOCIATED WITH HANDLING TRAFFIC INFRACTIONS ADMINISTRATIVELY, IN THE STATE DEPARTMENT OF MOTOR VEHICLES, RATHER THAN IN THE COURTS ARE EXAMINED.
Abstract
THE REPORT OPENS WITH A REVIEW OF THE METHODS EMPLOYED IN THE FEASIBILITY STUDY AND A DISCUSSION OF PROBLEMS WITH CALIFORNIA'S EXISTING SYSTEM FOR ADJUDICATING TRAFFIC OFFENSES. EXPERIENCES IN NEW YORK AND RHODE ISLAND WITH ADMINISTRATIVE ADJUDICATION ARE REVIEWED, AND FEDERAL GOVERNMENT REPORTS ARE NOTED. A MODEL FOR THE ADMINISTRATIVE ADJUDICATION OF TRAFFIC INFRACTIONS IN CALIFORNIA IS INTRODUCED. THE ADMINISTRATION, ORGANIZATION, AND OPERATION OF ADMINISTRATIVE ADJUDICATION ARE DISCUSSED. THE ECONOMIC IMPACT OF ADMINISTRATIVE ADJUDICATION IS PREDICTED, AND LEGAL CONSIDERATIONS ARE ANALYZED. THE FINDINGS OF A SURVEY OF PUBLIC OPINION REGARDING ADMINISTRATIVE ADJUDICATION ARE REPORTED. IT IS CONCLUDED THAT ADMINISTRATIVE ADJUDICATION IS LEGALLY FEASIBLE, ECONOMICALLY ATTRACTIVE, LIKELY TO LEAD TO ENHANCED TRAFFIC SAFETY AND MORE EFFECTIVE ALLOCATION OF COURT RESOURCES, AND FAVORED BY THE PUBLIC.
