The alternative dispute resolution (ADR) policy is designed to lead to an early settlement of pending litigation through voluntary settlement procedures.
Abstract
The Texas Legislature passed Senate Bill 1436, placing responsibility for carrying out ADR policy on the judiciary. The statute provides that settlement processes be nonbinding, all discussions be kept confidential, and settlement agreements be voluntary. To assure public awareness of dispute resolution services, the State bar has coordinated special symposiums, 'Dispute Resolution Week in Texas,' community forums, and open houses. ADR will enhance the image of the bar and judiciary and assure all Texas citizens of access to a more effective and less costly system of justice.
