Disappointed with the official government draft of the Federal Republic of Germany's Penal Code submitted to the Bundestag in 1962, a group of criminal law academicians composed an Alternative Draft of a Penal Code intended to reflect the most advanced postulates of modern penological theory; this book presents an English translation of this alternative draft.
Abstract
The General Part of the alternative draft presents mandates pertinent to the nature of the criminal law, criminal conduct, punishments, measures of security and reform, forfeiture and confiscation, and criminal charges and statutes of limitation. The Special Part defines specific offenses and punishments that involve crimes against the person. The offenses are presented under the following crime categories: crimes against life, against embryonic and fetal life, against physical integrity, against personal liberty, against sexual liberty, against minors, against personal honor, and against privacy. Other crime categories involve offenses which endanger the person and transportation hazards. A particular focus of the alternative draft is to provide protection to the public against recent technological developments that, if not reasonably controlled, threaten to impair important social values and interests.
