A SERIES OF SEVEN ARTICLES PRESENTED AS THE FIRST ISSUE OF A TWO-PART SYMPOSIUM DEALING WITH THE CONTENT, IMPLICATIONS, APPLICATIONS, AND IMPLEMENTATION OF THE AMERICAN BAR ASSOCIATION STANDARDS.
Abstract
THE AMERICAN BAR ASSOCIATION STANDARDS FOR CRIMINAL JUSTICE, IN SEVENTEEN VOLUMES, WERE THE FINAL PRODUCT OF ALMOST TEN YEARS OF DILIGENT WORK BY MORE THAN 100 OF THE NATION'S LEADING JURISTS, LAWYERS, AND LEGAL SCHOLARS. NOW IT IS FELT THAT A CONCENTRATED EFFORT SHOULD BE MADE TO INSURE THE APPLICATION AND IMPLEMENTATION OF THE ABA STANDARDS. THE ABA SECTION OF CRIMINAL JUSTICE HAS, THEREFORE, PUBLISHED TWO SPECIAL ISSUES OF ITS QUARTERLY REVIEW TO PUBLICIZE THE PROGRESS MADE IN IMPLEMENTING THE STANDARDS.BOTH ISSUES CONTAIN ARTICLES WRITTEN BY THOSE WHO DEVELOPED THE STANDARDS AND KNOW THEIR WORTH. INCLUDED IN THE FIRST ISSUE ARE PIECES TRACING THE HISTORICAL DEVELOPMENT OF THE STANDARDS AND THE PROGRESS OF THE IMPLEMENTATION EFFORT; A BROAD OVERVIEW OF THE SUBSTANTIVE CONTENT OF THE STANDARDS; A DISCUSSION OF THE ROLE THAT COURT RULE CAN PLAY IN IMPLEMENTATION; A REVIEW OF A FEDERAL COURT'S EXPERIENCE WITH THE OMNIBUS HEARING PROCEDURE SET FORTH IN THE ABA STANDARDS; AND AN EXPLANATION OF THE ALREADY PUBLISHED COMPARATIVE STUDY OF THE ABA STANDARDS AND THOSE OF THE NATIONAL ADVISORY COMMISSION ON CRIMINAL JUSTICE STANDARDS AND GOALS. PART 2 OFFERS ARTICLES WHICH ILLUSTRATE THE UTILITY OF THE STANDARDS TO APPELLATE AND TRIAL COURT JUDGES, PRACTICING ATTORNEYS, THE POLICE, AND THE MILITARY JUSTICE SYSTEM.
