SYSTEM WHICH PERMITS A PATROLMAN TO ISSUE A CITATION, ORDERING AN OFFENDER TO APPEAR IN COURT, TO PERPETRATORS OF CERTAIN MISDEMEANORS IN LIEU OF ARREST.
Abstract
THE CITATION PROCEDURE IS AVAILABLE TO THE PATROLMAN WHO BELIEVES THAT THE CITED MISDEMEANANT POSSESSES ENOUGH TIES IN THE COMMUNITY TO RENDER HIS COURT APPEARANCE LIKELY, AND WHO IS CONVINCED THAT THE OFFENDER WILL CEASE THE ACTIVITY WHICH PROMPTED THE CITATION. THIS PROCEDURE EFFECTIVELY BYPASSES BAIL AND OTHER PRELIMINARY COURT PROCESSES, AND CONSEQUENTLY STREAMLINES THE SYSTEM. FOCUSING ON THE EXPERIENCE IN EVANSTON, ILLINOIS, THE AUTHOR EXAMINES LEGAL ISSUES THAT ACCOMPANY THE PROCEDURE, THE REACTION OF THE POLICE TO THE USE OF CITATIONS, AND THE ULTIMATE EFFECT OF THE PROCEDURES ON APPEARANCES IN COURT. HE PROPOSES ALTERNATIVE PROCEDURES AND POLICIES WHICH HE CONTENDS WOULD CURE ANY LEGAL OR ADMINISTRATIVE DEFECTS IN THE PROCESS.
