IN DENOUNCING THE MYSTIFYING CHARACTER OF THE 1975 LAW ON DRUGS, THE ARTICLE STRESSES THE ONLY APPARENTLY INNOVATIVE AND PREDOMINANTLY REPRESSIVE ASPECTS OF THE NEW LEGISLATION.
Abstract
A BRIEF DESCRIPTION OF THE PRECEDING LAW AND ITS JURISPRUDENTIAL PRAXIS AND THE VARIOUS PROPOSALS SUBMITTED BY MEMBERS OF DIFFERENT POLITICAL PARTIES PRIOR TO THE APPROVAL OF THE CURRENT LAW IS USED BY THE AUTHORS TO EXPLAIN THE POLITICAL REASONS WHICH, SINCE THE 1968 WORKERS' AND STUDENTS' DEMONSTRATIONS, HAVE ACCOUNTED FOR THE FREQUENT RECOURSE IN ITALY TO SPECIAL LEGISLATION AS A MEANS OF STRENGTHENING THE EXISTING SYSTEM AND OF INDUCING SOCIAL CONSENSUS. IN CRITICIZING THE IDEOLOGY OF THE NEW LAW, THE AUTHORS ILLUSTRATE ITS VARIOUS SECTIONS, PLACING MAJOR EMPHASIS ON THE HARSHNESS OF THE SENTENCES. THE LACK OF DISCRIMINATION AMONG THE VARIOUS SUBSTANCES; THE INADEQUATE DIFFERENTIATION BETWEEN OCCASIONAL USER, CONSUMER AND TRAFFICKER; THE ORGANIZATION OF TREATMENT CENTERS, AND THE SYSTEM OF DATA COLLECTION. --IN ITALIAN
