This text provides a 1986 update of court and legislative activity in the field of alternative means of dispute resolution.
Abstract
In the area of commercial arbitration, case digests describe recent developments in general commercial fields, construction, insurance and medical malpractice, securities, and maritime arbitration. Commentaries discuss arbitraribility, punitive damages and public policy, mediator licensing, and private dispute resolution in long-term contracts (minitrials, mediation, med-arb). Case digests in labor arbitration cover arbitrator authority, the scope of judicial review, shop fees, and Miranda warnings in arbitration. Recent changes in foreign arbitration legislation and rules include those in Canada, the Netherlands, Paris, and London. Federal and State commercial dispute resolution legislation during the year is presented, including Virginia's Uniform Arbitration Act. The new American Arbitration Association rules for the impartial determination of union fees also are included. Table of cases, general index, and statutory and jurisdictional index.
