THIS PAMPHLET, WRITTEN IN NONTECHNICAL AND INFORMAL LANGUAGE, IS DESIGNED TO PROVIDE THE AVERAGE CITIZEN WITH INFORMATION AND ADVICE ON ARREST AND COURT PROCEDURES.
Abstract
GENERAL PROCEDURES FOR AN ACTUAL ARREST ARE DESCRIBED. THE AUTHORS URGE COOPERATION AND ALERTNESS AT ALL TIMES. STOP AND FRISK SITUATIONS, VEHICLE SEARCHES, ARREST AND SEARCH PROCEDURES IN THE HOME, AND ADVISED ACTIONS FOR THE ARRESTEE AT THE POLICE STATION ARE REVIEWED. RIGHTS AGAINST SELF INCRIMINATION, THE RIGHT TO DEFENSE COUNSEL, THE RIGHT OF PRIVACY, AND RIGHTS OF THE ACCUSED ARE DISCUSSED. BAIL PROCEDURES ARE DETAILED, AND SPECIAL EMPHASIS IS GIVEN TO THE NEED FOR ATTENDANCE AT SET COURT HEARINGS AND COMPLIANCE WITH ANY RESTRICTIONS ON ACTIVITY IMPOSED BY THE COURT. MISDEMEANOR AND FELONY CRIMES ARE DEFINED, AND COURT PROCESSES FOR EACH TYPE OF CRIME ARE DETAILED. SUGGESTIONS ON BEHAVIOR AT COURT APPEARANCES AND TRIALS ARE PROVIDED.
