This lecture focuses on the problems that face Nebraska county attorneys in implementing the forfeiture of conveyances and money used to facilitate drug transactions.
Abstract
The presentation first presents Nebraska State statutes that deal with asset seizure and trial, forfeiture distribution, and the establishment of the Drug Fund Board. The County Drug Fund Boards are authorized to disburse forfeiture funds to be used in drug law enforcement and drug abuse prevention. A section of various pleadings related to asset forfeiture encompass petitions and decrees for money only, car only, and both money and car. Also included are sample forms for a trial notice, the first amended petition, entry of appearance, a motion for substitute service, an order for service by publication, an affidavit for substitute service, a notice of publication, a trans memo, and a motion to dismiss. This document also contains a case control sheet for quick reference, a discussion of the county attorney's data requirement for forfeiture, and an outline of how to lay the foundation for the qualification of an expert in drug use and distribution. By-laws implemented by the Douglas County Drug Fund Board are attached.
