Abstract
IN ONLY A FEW JURISDICTIONS ARE CONTROLS PLACED ON DISSEMINATION OF ARREST RECORDS WHEN A CONVICTION IS NOT SECURED. THE RIGHT TO PRIVACY HAS NOT BEEN CONSTITUTIONALLY BROADENED TO INCLUDE A RIGHT TO NONDISSEMINATION OF ARREST RECORDS. THE AUTHOR CONCLUDES THAT IN MISSISSIPPI, THIS RIGHT SHOULD BE PROTECTED BY A SPECIFIC CODE PROVISION, TO ENSURE CONFIDENTIALITY AND TO RESTRICT DISSEMINATION OF ARREST RECORDS OF ONE WHO HAS BEEN ARRESTED BUT NOT CONVICTED OF A CRIME.
