A CRITICAL EVALUATION OF THE CALIFORNIA APPELLATE COURTS WITH RECOMMENDATIONS FOR INCREASING CASELOAD HANDLING CAPABILITIES AND FOR IMPROVING SYSTEM COST-EFFICIENCY.
Abstract
THIS STUDY BEGINS WITH A SUMMARY DESCRIPTION OF THE APPELLATE MACHINERY, INCLUDING THE STRUCTURAL FRAMEWORK, JURISDICTION AND COMPOSITION OF THE VARIOUS APPELLATE COURTS IN CALIFORNIA. THE NEXT CHAPTER CONTAINS A DETAILED ANALYSIS OF APPELLATE PROCEDURES FROM JUDGMENT IN THE TRIAL COURT TO THE CONCLUSION OF THE APPEAL, INCLUDING DISCUSSIONS OF THE PRACTICES OF EACH DISTRICT AND SPECIFIC RECOMMENDATIONS FOR MODIFICATION. PERSONNEL REQUIREMENTS, DIVISIONAL ARRANGEMENTS, AND THE NEED FOR ADMINISTRATIVE ASSISTANTS ARE REVIEWED FOLLOWED BY RECOMMENDATIONS CONCERNING THE DISTRICTING AND LOCATION OF THE COURTS. REPRESENTATION OF INDIGENT CRIMINAL DEFENDANTS, A STATISTICAL ANALYSIS OF THE CASELOAD AND A REVIEW OF LIBRARY RESEARCH FACILITIES ARE CONTAINED IN THE FOLLOWING CHAPTERS. THE REPORT CONCLUDES WITH RECOMMENDATIONS OF AREAS WHICH WARRANT FURTHER STUDY AND EXPERIMENTATION. (AUTHOR ABSTRACT)
