DESCRIPTION OF DEVELOPMENT AND IMPLEMENTATION OF THIS FIRST SET OF STATE-WIDE STANDARDS FOR PROSECUTORIAL DISCRETION IN THIS AREA, PLUS SUMMARIES OF BOTH THE STANDARDS AND THE CONTENTS OF THE CRIME CHARGING MANUAL.
Abstract
THE CRIME CHARGING STANDARDS COVER THE FOLLOWING FIVE AREAS: EVIDENTIARY SUFFICIENCY, CHARGE SELECTION, PROSECUTORIAL ALTERNATIVES, OFFICE PROCEDURES, AND SPECIAL STANDARDS. THE CRIME CHARGING MANUAL IS DESIGNED TO FACILITATE THE IMPLEMENTATION OF THE GENERAL CRITERIA AND STANDARDS CONTAINED WITHIN THE STANDARDS. IT CONTAINS MODEL FORMS TO FACILITATE CASE PROCESSING AND TO IMPROVE RELATIONS WITH CIVILIAN WITNESS, MODEL SEARCH WARRANT FORMS, AND PLEADING FORMS FOR PRACTICALLY EVERY FELONY AND MISSDEMEANOR IN CALIFORNIA USED WITH ANY DEGREE OF FREQUENCY. THE MANUAL ALSO CONTAINS APPROXIMATELY 30 SECTIONS ON THE CHARGING PROBLEMS POSED BY FREQUENTLY CHARGED FELONIES AND MISDEMEANORS.
