This book describes various laws, techniques, and remedies available to community residents under civil law to fight drug-related problems.
Abstract
The first chapter addresses common law actions, including small claims and court-arbitrated actions, nuisance actions, negligence actions, and trespass and waste actions. The second chapter discusses remedies available through governmental agencies to challenge a license and permit of any person or business that engages in or condones drug-related activities. Another chapter explores the possibility of using the Federal Racketeer Influenced and Corrupt Organizations (RICO) Act to attack crack houses and street drug markets. The book also outlines government forfeiture laws. The final two chapters focus on measures which can be used to combat drug activity in housing projects, including summary eviction proceedings, appointment of a building administrator, and special lease provisions, as well as laws in New York State or New York City which could be used more effectively to confront drug traffic and crimes.
