RECOMMENDATIONS TO IMPROVE INTERNAL DISCIPLINE AND GRIEVANCE PROCEDURES WITHIN THE ROYAL CANADIAN MOUNTED POLICE ARE OFFERED IN THIS REPORT PREPARED BY THE COMMISSION OF INQUIRY.
Abstract
THE RECOMMENDATIONS ARE BELIEVED TO BE CONSISTENT WITH CONTEMPORARY POLICE MANAGEMENT THEORY, AND IT IS FELT THAT THEY CAN BE IMPLEMENTED WITH NO THREAT TO THE OPERATIONAL EFFICIENCY OF THE ROYAL CANADIAN MOUNTED POLICE. THE REPORT OF THE COMMISSION OF INQUIRY IS ORGANIZED ACCORDING TO FIVE SUBSTANTIVE SECTIONS. A HISTORICAL PERSPECTIVE ON INTERNAL DISCIPLINE, GRIEVANCE, AND PUBLIC COMPLAINT PROCEDURES FROM 1873 TO 1975 IS THE FOCUS OF THE FIRST SECTION. CONSIDERATION IS GIVEN TO THE POLICE FORCE, CONDITIONS OF POLICING, THE DISCIPLINE SYSTEM, THE ADMINISTRATION OF JUSTICE, FOUNDATIONS OF DISCIPLINE (RULES OF CONDUCT, DUE PROCESS, PENALTIES, AND APPEALS), THE EVOLUTION OF FORCE DISCIPLINE, CHANGES IN THE DISCIPLINE SYSTEM, GRIEVANCE PROCEDURES, AND COMPLAINTS AGAINST THE POLICE FORCE. THE SECOND SECTION DEALS WITH PUBLIC COMPLAINT PROCEDURES AND CONCERNS CITIZENS AND POLICE RESPONSE AND THE IMPLEMENTATION OF A REMEDIAL SYSTEM OF HANDLING PUBLIC COMPLAINTS. THE THIRD SECTION DISCUSSES THE FEDERAL POLICE OMBUDSMAN IN RELATION TO THE NEED FOR AN INDEPENDENT AUTHORITY, THE OMBUDSMAN AS A REVIEWING AUTHORITY, THE SPECIALIZATION OF THE OMBUDSMAN'S ROLE, AND THE AUTHORITY AND FUNCTIONS OF THE FEDERAL POLICE OMBUDSMAN. THE FOURTH SECTION ADDRESSES INTERNAL DISCIPLINE PROCEDURES (DISCIPLINARY SANCTIONS AND RELATED ISSUES), FORMAL PROCEDURES (INVESTIGATION, SUSPENSION, THE DISCIPLINARY TRIBUNAL, AND SERVICE FILE RECORDS), AND MATTERS INCIDENTAL BUT RELATED TO THE DISCIPLINE SYSTEM. THE FINAL SECTION IS CONCERNED WITH GRIEVANCE PROCEDURES (INFORMAL RESOLUTION OF GRIEVANCES, FORMAL GRIEVANCE PROCEDURES, GRIEVANCE INITIATION, REVIEW BOARDS, THE ROLE OF THE FEDERAL POLICE OMBUDSMAN IN THE GRIEVANCE PROCESS, AND GROUP GRIEVANCES). APPENDIXES PRESENT FURTHER INFORMATION ON INTERNAL DISCIPLINE AND GRIEVANCE HANDLING. (DEP)
