THIS PAPER EXAMINES THE POLICIES AND PRACTICES OF THE PAROLE AND PARDONS BOARDS, WITH EMPHASIS ON PAROLEE ELIGIBILITY FOR COMMUTATION REVIEW, AND SUGGESTS ALTERNATIVE STYLES OF PAROLE SUPERVISION AND COMMUTATION.
Abstract
INCONSISTENT PROCEDURES WERE FOUND WITHIN THE PAROLE BOARD AND PARDON BOARD. UNDER ITS SPECIAL COMMUTATION PROCEDURE, THE PAROLE BOARD WAS THE APPLICANT FOR THE CLIENT AT FIVE OR TEN YEARS. IN THE PETITION FOR COMMUTATION, THE INDIVIDUAL WAS THE APPLICANT AND COULD BEGIN THE PROCEDURE AT ANY TIME. DIFFERING PROCEDURES FOR TERMINATING CASES UNDER SUPERVISION BY THE PAROLE BOARD WERE ALSO REVEALED. BASED ON STUDY DATA THAT MOST PAROLE VIOLATIONS OCCUR IN THE FIRST TWO YEARS, THE AUTHORS SUGGEST A MODEL PROCEDURE FOR COMMUTATION OF MAXIMUM PAROLE SENTENCE AFTER TWO YEARS FREE OF VIOLATION. IN ADDITION, PAROLEES ARE REQUIRED TO HAVE BEEN GAINFULLY EMPLOYED FOR AT LEAST ONE YEAR OF THE TWO YEARS ON PAROLE. THE OPERATION OF THIS MODEL PROCEDURES DETAILED ALONG WITH VARIOUS IMPLEMENTATION ALTERNATIVES (A THREE YEAR PLAN, EXCLUSION OF LEFERS, NON-REPORTING PAROLE SUPERVISION. SUGGESTIONS ARE ALSO MADE FOR IMPLEMENTATION AND THE NEED FOR FURTHER RESEARCH. A BIBLIOGRAPHY IS INCLUDED.
