THE DEGREE OF CONFORMITY BETWEEN THE ALABAMA CRIMINAL JUSTICE SYSTEM AND AMERICAN BAR ASSOCIATION (ABA) STANDARDS IS ASSESSED, AND RECOMMENDATIONS PERTAINING TO ALABAMA'S ADOPTION OF THE STANDARDS ARE PRESENTED.
Abstract
THE ANALYSIS WAS FUNDED BY LEAA AND ABA AND CARRIED OUT BY A COMMITTEE OF ALABAMA JUDGES AND ATTORNEYS, WITH THE COOPERATION OF THE STATE BAR, SUPREME COURT, COURT OF APPEALS, COURT MANAGEMENT DEPARTMENT, AND LAW ENFORCEMENT PLANNING AGENCY, AND THE ABA CRIMINAL JUSTICE SECTION. EACH ABA STANDARD IS SET FORTH, WITH REFERENCE TO THE PERTINENT ALABAMA STATUTE, DECISIONAL LAW, COURT RULE, AND/OR LEGAL PRACTICE. THE COMMITTEE'S RECOMMENDATION FOR ADOPTING, MODIFYING, OR REJECTING THE STANDARD IS THEN STATED. THE STANDARDS DEAL WITH THE FOLLOWING ASPECTS OF THE CRIMINAL JUSTICE PROCESS: SENTENCING ALTERNATIVES AND PROCEDURES, POSTCONVICTION REMEDIES, APPELLATE REVIEW OF SENTENCES, ELECTRONIC SURVEILLANCE, JOINDER AND SEVERANCE, SPEEDY TRIAL, TRIAL BY JURY, GUILTY PLEAS, PROBATION, DEFENSE SERVICES, PRETRIAL RELEASE, DISCOVERY AND PRETRIAL PROCEDURE, FAIR TRIAL AND FREE PRESS, FUNCTION OF THE TRIAL JUDGE, PROSECUTION FUNCTION, DEFENSE FUNCTION, AND CRIMINAL APPEALS.
