Abstract
THE DEVELOPMENT OF THE RIGHT OF CONJUGAL PRIVACY FOR NONPRISONERS IS REVIEWED AND ITS APPLICABILITY TO MARRIED PRETRIAL DETAINEES AND CONVICTED PRISONERS DEMONSTRATED. CASES ILLUSTRATING THE APPROPRIATE STANDARD OF JUDICIAL REVIEW IN A PRISON CONTEXT AND VARIOUS APPROACHES CURRENTLY EMPLOYED BY THE COURTS ARE ALSO DISCUSSED.
