THIS REPORT CONTAINS A COMPREHENSIVE OVERVIEW AND EVALUATION OF THE SOUTH DAKOTA JUVENILE AND ADULT CORRECTIONAL SYSTEM, AND RECOMMENDATIONS FOR IMPROVEMENT OF THE SYSTEM AND DEVELOPMENT OF ALTERNATIVE POLICIES.
Abstract
DATA FOR THIS REPORT WERE GATHERED BY MEANS OF PERSONAL INTERVIEWS WITH CORRECTIONAL STAFF, RESIDENTS OF SOUTH DAKOTA CORRECTIONAL FACILITIES, JUDGES, TREATMENT PROGRAM PERSONNEL, AND OTHERS CONCERNED WITH SOUTH DAKOTA CORRECTIONS. QUESTIONNAIRES WERE ALSO SENT TO CIRCUIT COURT JUDGES, SHERIFFS, CHIEFS OF POLICE, TWO JUVENILE DETENTION FACILITIES, AND PROBATION DEPARTMENTS. THE REPORT INCLUDES SEPARATE CHAPTERS ON JUVENILE AND ADULT SERVICES, REFLECTING THE TRADITIONAL SEPARATION OF THESE TWO TYPES OF SERVICE, WITHIN THESE CHAPTERS, PROGRAMS ARE DISCUSSED IN GENERAL ORDER OF THE CASE FLOW (I.E. POLICE, COURT, DETENTION, PROBATION, INSTITUTIONS). ANALYSES OF THE JUVENILE CODE AND THE ADULT CRIMINAL CODE ARE PRESENTED AS WELL. PROGRAMS CUTTING ACROSS BOTH JUVENILE AND ADULT SERVICES ARE DISCUSSED AND EVALUATED IN SEPARATE, INDIVIDUAL CHAPTERS. THESE INCLUDE: DATA COLLECTION AND PROGRAM EVALUATION EFFORTS OF SOUTH DAKOTA CORRECTIONS; THE ORGANIZATION OF CORRECTIONAL SERVICES IN SOUTH DAKOTA; LEAA FUNDING AND PLANNING; INDIANS IN THE SOUTH DAKOTA CORRECTIONAL SYSTEM; AND SUCH SUPPORT SERVICES AS VOLUNTEER PROGRAMS AND TRAINING. A SECTION ON PROGRAM COSTS AND PRIORITIES IS PRESENTED AS WELL. RECOMMENDATIONS ARE CONTAINED IN EACH CHAPTER. IN GENERAL THE REPORT CALLS FOR A UNIFIED CORRECTIONS SYSTEM FOR SOUTH DAKOTA. THE REPORT RECOMMENDS CONSOLIDATION OF SOUTH DAKOTA'S CORRECTIONAL SERVICES IN THE DIVISION OF CORRECTIONS OF THE DEPARTMENT OF SOCIAL SERVICES, WITH LOCAL SERVICES BEING PROVIDED ON A REGIONAL BASIS THROUGH DISTRICTS CORRESPONDING TO THE JUDICIAL CIRCUITS. A PERMANENT CORRECTIONS ADVISORY COUNCIL IS ALSO RECOMMENDED. (AUTHOR ABSTRACT MODIFIED)
