This volume presents the keynote address, three other papers, and the findings and recommendations from a 1983 conference sponsored by the Roscoe Pound-American Trial Lawyers Foundation. The conference focused on the courts and their relationships with the other branches and institutions of the U.S. Government.
Abstract
A presentation of five disparate views on the appropiateness of judicial activism emphasizes that the two basic issues are the legitimacy of power of a nonelected judiciary and the nature of the issues that courts are suited to manage. Three additional papers examine congressional power to limit Federal court jurisdiction, the judicial supervision of public institutions, and the history and limitations of administrative law. The 17 positions on which the conference participants voted, the results of the votes, and commentary on each position are appended. The text of the U.S. Constitution, a list of conference participants and a list of fellows of the sponsoring foundation are also included.
