A PARTICIPANT'S GUIDE IS PROVIDED TO THE USE OF MEDIATION TECHNIQUES IN THE RESOLUTION OF CONFLICTS GROWING OUT OF EMPLOYMENT OR INTRAFAMILY PROBLEMS.
Abstract
THE MEDIATION PROCESS OUTLINED IN THIS GUIDE USUALLY REQUIRES ONE TO THREE SESSIONS. IF PROPERTY OR BUDGET CONCERNS ARE THE ISSUES AT HAND, MUCH OF THE WORK OF MEDIATION IS ACCOMPLISHED BETWEEN SESSIONS. USUALLY THE TWO PARTIES TO THE DISPUTE AND THE MEDIATOR ARE THE ONLY ONES INVOLVED, ALTHOUGH IF MORE PERSONS ARE AFFECTED BY THE ISSUES, THEY MAY BE INCLUDED (E.G., SESSIONS DEVOTED TO DIVORCE SETTLEMENTS MAY INCLUDE THE CHILDREN). MEDIATION FOLLOWS A CERTAIN PROGRESSION. THE FOUR STAGES ARE AS FOLLOWS: (1) SETTING THE STAGE, (2) DEFINING THE ISSUES, (3) PROCESSING THE ISSUES, AND (4) RESOLVING THE ISSUES. IN THE FIRST STAGE THE GROUND RULES OF THE PROCESS ARE LAID DOWN, AND IN THE SUCCEEDING STAGES, THE PARAMETERS OF THE CONFLICT ARE DEFINED, DIFFERING VIEWPOINTS ARE EXPRESSED ON THE ISSUES, AND FINALLY, A SATISFACTORY RESOLUTION IS REACHED THROUGH COMPROMISES ACHIEVED UNDER THE DIRECTION OF THE MEDIATOR.
