SURVEY AND EVALUATION OF THE STATUS OF EFFECTIVE AND PENDING LAWS, AWARDS GRANTED, AND OTHER PERTINENT INFORMATION.
Abstract
THIS REPORT EXAMINES THE AMERICAN BAR ASSOCIATION'S PROPOSED UNIFORM CRIME VICTIMS REPARATION ACT, THE MODEL RECOMMENDED BY THE ABA TO STATE LEGISLATURES FOR ADOPTION. IT ALSO FOCUSES ON THE SCOPE OF CURRENT BILLS PENDING IN CONGRESS AND NOTES THE VARIABLE CHARACTERISTICS OF STATE PROGRAMS OF VICTIM COMPENSATION. TOPICS CONSIDERED INCLUDE THE TYPES OF ELIGIBLE RECIPIENTS, COMPENSABLE ACTS, TYPES OF ALLOWABLE PAYMENTS, RESTRICTIONS UPON COMPENSATION ELIGIBILITY, AND MINIMUM AND MAXIMUM CLAIM AWARDS. IN ADDITION, ATTENTION IS GIVEN TO THE STRENGTHS AND WEAKNESSES OF EXISTING LAWS AND TO THE PRESENTATION OF A MODEL WHICH COINCIDES WITH THE NATIONALLY DOMINANT TENDENCIES. A TABLE SUMMARIZING THE PERTINENT CHARACTERISTICS OF EACH EXISTING STATE PROGRAM OF VICTIM COMPENSATION IS CONTAINED IN THE APPENDIX.
