Abstract
THIS VOLUME PRESENTS ALL ASPECTS OF REPRESENTING DEFENDANTS ACCUSED OF VIOLENT CRIMES, FROM THE INITIAL INTERVIEW TO THE END OF THE TRIAL. CHAPTERS 1 THROUGH 14 PRESENT PRE-TRIAL PROBLEMS, EMPHASIZING THOROUGH INVESTIGATION. THE AUTHORS DEAL WITH THE INITIAL INTERVIEW, ARRAIGNMENT, PLEA, BAIL, GRAND JURY PROCEEDINGS, AND OTHER PRELIMINARY MATTERS. CHAPTERS 15 THROUGH 24 COVER PREPARATION FOR COURT AND TRIAL. THIS SECTION PROVIDES THE DEFENSE ATTORNEY WITH SUGGESTIONS FOR TRIAL STRATEGY AND TACTICS FOR JURY SELECTION, OPENING STATEMENTS, PLEA NEGOTIATIONS, AND ILLEGALLY OBTAINED EVIDENCE AND CONFESSIONS. ALSO INCLUDED ARE SAMPLE DIRECT AND CROSS EXAMINATIONS AND SAMPLE SUMMATIONS FROM THE AUTHORS' TRIAL EXPERIENCE. THE FINAL PORTION OF THE VOLUME, CHAPTERS 25 THROUGH 37, OFFERS A DETAILED EXPLANATION OF SPECIFIC HOMICIDE CRIMES, DEFENSES, AND EVIDENCE - INCLUDING A COMPREHENSIVE ANALYSIS OF THE GRADES AND DEGREES OF MURDER, DEFINITION OF MANSLAUGHTER, AND THE ELEMENTS OF HOMICIDE. A DISCUSSION OF THE CRIMES OF ASSAULT, BATTERY, AND KIDNAPPING IS ALSO PRESENTED. THIS VOLUME IS A PRACTICAL MANUAL WHICH PROVIDES SPECIFIC SUGGESTIONS, SAMPLE FORMS AND INTERVIEW CHECKLISTS, AS WELL AS ANSWERS TO QUESTIONS WHICH ARISE IN TRIALS OF DEFENDANTS ACCUSED OF VIOLENT CRIMES.
