THIRTY CANADIAN DEFENSE LAWYERS WERE INTERVIEWED TO DETERMINE FUNCTIONS WHICH THEY PLAYED IN COURT, AND THEIR OPINIONS ON OTHER PARTICIPANTS.
Abstract
THE SURVEY FINDINGS INDICATED THAT THE DEFENSE ADVOCATES EXPERIENCED ROLE CONFLICT WHICH AROSE FROM DIFFERENCES IN THEIR OWN VIEWS OF THEIR TASK, AND WHAT OTHER COURT OFFICIALS EXPECTED OF THEM. THE NEW YOUNG OFFENDERS BILL BEING CONSIDERED BY THE CANADIAN LEGISLATURE COULD RESOLVE THIS PROBLEM BY INCREASING THE LEGALISTIC ORIENTATION AT THE ADJUDICATORY STAGE, AND BY ALLOWING LAWYERS TO RESPOND IN A FRIEND OF THE COURT OR SOCIAL WORK CAPACITY AT THE DISPOSITIONAL PROCEEDINGS.
